Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Fixivo, including our website at fix-ivo.com and mobile applications (the “Service”), operated by MagiQa, Inc. (“MagiQa”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms.
1. Who may use Fixivo
Fixivo is designed for independent handymen, solo contractors, maintenance professionals, and small trade businesses. You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract.
2. Your account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity under your account.
- You agree to provide accurate account information.
- You may delete your account at any time in the app or at fix-ivo.com/delete-account.html.
3. Your business data
You retain ownership of the customer, job, invoice, and other business data you enter into Fixivo. You grant us a limited license to host, process, and display that data solely to provide the Service to you.
You are responsible for ensuring you have the right to collect and store customer information you enter into Fixivo and for complying with applicable laws in your jurisdiction.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to access another user’s account or our systems without authorization
- Interfere with or disrupt the Service
- Upload malware or abusive content
- Reverse engineer or misuse the Service except as permitted by law
5. Payments
If you use invoice payment features, payments are processed by third-party providers such as Stripe. Their terms and privacy policies apply to payment processing. We are not a bank or money transmitter.
6. Service availability
We strive to keep Fixivo available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where practicable.
7. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIQA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.
10. Privacy
Our Privacy Policy explains how we handle information. It is incorporated into these Terms by reference.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies.
